Terms and Conditions

Article 1 General
Member 1
These general terms and conditions apply, to the exclusion of all other general terms and conditions, to all activities and/or events to be organized by WGTF/DGTF for a client or student and comprise 8 articles. If other general terms and conditions apply, the general terms and conditions of the WGTF of the Netherlands will prevail in the event of any contradiction.
Paragraph 2
An activity or event includes clinics, competitions, competitions, golf days, HCP courses, group lessons, internships and individual golf lessons, seminars, training weeks, WOYG program, theme training and demo workshops.
Paragraph 3
A client is defined as the student of the WGTF / DGTF. WGTF is the association under which the activities fall and the DGTF is the foundation that provides the training.
Paragraph 4
The general terms and conditions apply during the entire (communication) process that precedes the conclusion of an agreement and the process after the conclusion of the agreement until after completion of the agreed activity, event or course.
The general terms and conditions relate to the services and activities provided or carried out by WGTF/DGTF.

THE ESTABLISHMENT OF AN AGREEMENT
Article 2 Student registration
Member 1
The registration form includes a description of the course and the program, the contact person of WGTF/DGTF, the contact details of the student, at what price WGTF/DGTF can offer the course desired by the student and, if already known, the date or class and training dates.
Paragraph 2
A registration is binding for WGTF/DGTF, with the exception of moving abroad and permanent injury that makes it impossible to practice golf. By registering you agree to the articles of association of the WGTF association and the general terms and conditions of the WGTF/DGTF.
Paragraph 3
A student can convert a request into a definitive reservation by returning the signed registration form by email. WGTF/DGTF confirms this reservation by email and will book a course spot and order the clothing package. The student hereby agrees to our general terms and conditions. When registering from level III, this also means a definitive confirmation of membership and license of the WGTF association for at least 2 years. The WGTF golf teacher license is also linked to this membership and participation in all WGTF/DGTF activities is guaranteed. Your membership and license of the DGTF/WGTF must be done in writing before October 1. If membership is canceled after October 1, you must pay the annual contribution for the coming year. The contribution invoice will be sent annually at the end of October and the amount must be paid within the payment term stated on the invoice. When 1 participant registers for a WGTF course by sending their personal data (address details and date of birth), he/she agrees to the general terms and conditions and the registration is binding. WGTF/DGTF unequivocally assumes that all registered participants agree with their registration and the general terms and conditions.
Paragraph 4
An agreement has been concluded through the booking. The WGTF is entitled to exclude or expel the student in the event of misconduct. to suspend the training. In the event of termination of the training for whatever reason, own request, suspension or exclusion, the person concerned is not entitled to a refund of the paid training or course fee and the student / ex-student may not make any statements or the like in any form that could damage the good name of the student. could harm the WGTF.
Paragraph 5
A booking made in this way is binding for both parties and no longer needs to be confirmed in writing to the student.
Paragraph 6
When a booking has been made, WGTF/DGTF can request a (down) payment of 30% of the estimated invoice value. Payment must be made within 8 days.

Article 3 Registration
Member 1
After registering for the course using the registration form sent by the student, the student will receive an invoice. This must be paid within the stated payment term on the invoice.
Paragraph 2
If interim changes that increase or decrease cost price occur, WGTF/DGTF is entitled to pass these on to the student up to a maximum of 10%. Changes in VAT rates will be fully charged to the student (100%).
Paragraph 3
If invoices are not paid within the term referred to in Article 8.1, the student will be in default simply by the expiry of the agreed payment term, without notice of default being required, regardless of whether or not the student can be held responsible for exceeding this term.
Paragraph 4
All extrajudicial and judicial costs incurred by WGTF/DGTF in the context of a dispute with the student, both plaintiff and defendant, will be borne by the student. The extrajudicial collection costs to be determined in accordance with the collection rate of the Dutch Bar Association, the judicial collection costs on the amount actually paid by WGTF/DGTF in respect of the procedure, even insofar as this exceeds the liquidated legal costs.

Article 4 Cancellation
Member 1
Once the student has started the first part of the course, no refund is possible on the paid course amount. Due to (long-term) illness or immigration, a suitable solution will be sought for each individual situation.
Paragraph 2
Prior to the start of a seminar, the student has the right to reschedule the golf course in question up to a maximum of 72 hours in advance by deregistering via the reservation system that the WGTF/DGTF uses online at wgtf.nl.
Paragraph 3
In the event of rescheduling within 72 hours as referred to in Article 4, paragraph 1, the WGTF/DGTF of the planned course, lesson module or other courses will charge the student 100 % of the amount. Invoices must be paid within 8 days.
Paragraph 4
In the event that the student still has outstanding amounts on WGTF/DGTF teaching modules, the WGTF/DGTF may decide to exclude him from other courses.
Paragraph 5
The student can register a maximum of once per module in the online reservation system of the WGTF/DGTF as stated in paragraph 2. Multiple registrations per teaching module will be arbitrarily removed by the WGTF/DGTF.

Article 5 Moving

In exceptional cases, WGTF/DGTF can, at the customer's request, move a golf lesson/golf course/training and/or other courses to another date or location. The decision on whether or not to move the above rests solely with WGTF/DGTF. If the course costs on the new course date are higher than on the canceled date, the student must pay the additional costs.
Paragraph 2
WGTF/DGTF is entitled to change dates, location or teacher at any time. These changes will be made in the online reservation system and this system is also leading/binding for reservations for lessons and/or courses.

Article 6 Payment
Member 1
For each reserved golf lesson/golf course and/or training module, the student will receive an invoice from WGTF/DGTF by email.
Paragraph 2
Payment must be made no later than the due date stated on the relevant invoice. WGTF/DGTF aims to send the (first) invoice to the customer two weeks after the start of the golf lesson/golf course. WGTF/DGTF uses a payment term of 8 days.
Paragraph 3
The student must pay the full costs of the training golf lesson/golf course to WGTF/DGTF no later than 8 days after the golf lesson/golf course.
Paragraph 4
If the student has not paid the amount due in full within the set period, WGTF/DGTF will send the student a one-off payment reminder in which the student is offered the opportunity to pay within 7 days of receiving that reminder. If the student has not paid the amount due in full within that period, the student will be in default without further notice of default.
Paragraph 5
If a student does not pay within the specified period, additional collection costs will be borne by the student. WGTF/DGTF also claims statutory commercial interest from the due date of the invoice until the day of full payment.
Paragraph 6
In the event of late payment, WGTF/DGTF will hand over the claim to a collection agency.
Paragraph 7
In case of outstanding invoices, WGTF/DGTF can exclude the student from future training and/or training courses, this will be done via an email to the student.

Article 7 Cancellation by WGTF/DGTF
Member 1
WGTF/DGTF is entitled to move the event in the event of force majeure. Any amount already paid by the student will be used as a down payment for the event on the alternative date(s).
Paragraph 2
WGTF/DGTF is not liable for costs incurred by the student or third parties related to this cancellation.
Paragraph 3
Force majeure also includes:
- poor condition/unplayability of the golf course and/or equipment due to exceptional weather conditions;
- natural disasters such as floods, earthquakes or storms;
- cancellations as a result of which the minimum participants for the event are no longer reached
- sudden illness and/or unavailability of staff who cannot be replaced in time, such as golf professionals
- local, regional or national measures that make the location (golf course and/or practice facilities) temporarily unavailable, outdoors
blame of the WGTF/DGTF.
- unforeseen circumstances to the golf course or facilities (e.g. damage) that make them temporarily unavailable, through no fault of the WGTF/DGTF
- The golf course canceling the course
- Pandemic that we must adhere to in accordance with RIVM/government guidelines, both at home and abroad
Paragraph 4
In the event of force majeure, there is emphatically no definitive cancellation of the event, training or course. Both parties are obliged to provide the course (for the WGTF/DGTF) and to administer the course (for the student). Once the period
due to force majeure as a result of which the course cannot take place (e.g. natural disaster, pandemic, unusability of the golf course), both parties are obliged to determine a new date within 6 months. When exceptional circumstances occur, such as a pandemic and/or other unforeseen circumstances, the target periods and guidelines of the training may of course be exceeded.
If the student definitively cancels an event or course when rescheduling, despite the options offered, no refund will be made on the total invoice.

Article 8 Invoicing
Member 1
The student tacitly agrees to receiving a digital invoice for the services purchased. He/she is free to request a written copy at any time. This will be shipped free of charge.

Article 9 Liability
Member 1
WGTF/DGTF is not liable for damage caused by a subordinate of WGTF/DGTF or a third party.
Paragraph 2
The student is liable for any form of damage caused by him/her or a participant of the event and/or one of the courses.
Paragraph 3
The student must take out insurance for the training and/or courses themselves. WGTF/DGTF is in no way responsible for damage and/or injuries incurred during a training and/or activity of the WGTF/DGTF.
Paragraph 4
We will trade on goods ordered under the same conditions and guarantees that our suppliers maintain.

Article 10 Applicable law and disputes
Member 1
All legal relationships to which WGTF/DGTF is a party are exclusively governed by Dutch law, even if an obligation is wholly or partially performed abroad or if the party involved in the legal relationship is domiciled there. All possible disputes will be submitted to the competent court in the Amsterdam district; or, at the discretion of WGTF/DGTF, at the competent court of your place of residence. These conditions are presented to you for your information and agreement upon registration.
